Casio Computer Co., Ltd., a Japanese company whose registered office is at 6-2, Hon-machi 1-chome, Shibuya-ku, Tokyo 151-8543, Japan ("Casio", "we", "us", "our") takes the protection of your personal data extremely seriously. This Privacy Notice ("Privacy Notice") describes how Casio processes and protects your personal data that are any information relating to an identifiable natural person ("Personal Data") collected and processed when using our app, CASIO WATCHES ("App"). This Privacy Notice also explains your rights to your Personal Data and how you can reach us to get answers to questions you may have about our privacy practices.
This Privacy Notice exclusively applies to the processing of your Personal Data when using our App. This Privacy Notice does not apply to the processing of your Personal Data when creating and using CASIO ID (“CASIO ID”), the user account that allows you to centrally store and manage master data and functions as your access key across various offerings, solely and/or other apps we provide. Such processing is governed by other privacy policies, so when using CASIO ID with this App, the privacy notice for CASIO ID applies to you additionally.
Please read the following carefully to understand how we will process your Personal Data provided via your use of the App.

2. Categories of Personal Data
When you use the App, we collect any information about you including Personal Data automatically transmitted from the App to our servers, specifically:
(i) CASIO ID Data:
This App requires you to register with and sign up for CASIO ID before you can use this App. You provide us with information including your name, email address registered with your CASIO ID (hereinafter jointly "CASIO ID Data"). The data is required to log in to the App with your CASIO ID, and is the only information that is transmitted to the App from your CASIO ID registration data.
(ii) Profile Data:
We collect and use your profile data registered by yourself with the App, including your birth date, height, weight, gender and any other profile data (hereinafter jointly "Profile Data") when you choose to provide the data;
(iii) Product Information:
We collect and use PLMN (Public Land Mobile Network), serial number, model name, time zone, system and setting data of the watch or other product used in combination with the App ("Product").
(iv) Uploaded Data:
We collect to images, pictures, videos, texts and any other information that you uploaded, posted, transmitted or otherwise made available on the App (hereinafter jointly "Uploaded Data"), if you provide so on the App.
(v) Device Data;
When you access or use our App, we collect and use your system or setting data (consent about privacy, push notification and access Device’s media storage) and other device information of your mobile device in which the App is installed (together with Product, collectively, "Devices") including device identifier, model name, OS version and the setting data of the Devices, and date and time of usage and access to the App, and other user usage data in the App (hereinafter jointly "Device Data").
(vi) Location Data:
We collect and access GPS and GNSS location data, Wi-Fi status information, such as information about Wi-Fi access points and base points near the Devices location, recorded by the Devices (hereinafter jointly "Location Data"), if you grant us access to your location. You can always remove our access using your Product or your Device settings. The data collected depending on the model of Devices you use. We also identify your location by using a variety of technologies, including GPS, GNSS the Wi-Fi points you are accessing the App through and mobile/cell tower triangulation.
(vii) Activity Data:
We collect and use the data, recorded in the App and Devices [*1], to estimate your health status like your heart rate, numbers or steps you take, VO2max, sleep stages, location data, date and time of activity, and other data recorded by sensors on your Product that can be used to make inferences about or detect the health status of an individual (including numerical data calculated from measurement of your activity data, hereinafter jointly "Activity Data"). The data collected varies depending on which Product you use. When your Product syncs with our App, data recorded on your Product is transferred from your Product to our servers.
(viii) Form Data:
We collect any other information relating to any individuals which you have provided us in any forms you may have submitted to us, or via other forms of interaction with you (hereinafter jointly "Form Data").
[*1] Depending on the model of Devices, certain activity data cannot be functionally recorded by the App and Devices. For example, if your Product does not have a heart rate sensor, your heart rate, VO2max, step count and/or sleep stage are not measured and recorded by the Devices and therefore is not collected and processed by us unless manually entered into the App by yourself.
3. Health and other Special Categories of Personal Data
To the extent that information we collect is health data or another special category of Personal Data subject to the applicable data privacy laws, we ask for your explicit consent to process the data. We obtain this consent separately when you take actions leading to our obtaining the data, for example, when you pair your Product to the App, grant us access to your exercise or activity data from the Third-party App. You can use your access settings and tools to withdraw your consent at any time, including by stopping use of a feature, removing our access to the Third-party App, unpairing your Products, or deleting your data or your CASIO ID.
4. Purpose of usage
We use your Personal Data for the following purposes ("Purposes");
(1) Performance purposes, i.e.:
- to operate the App by providing you with the respective functionalities of the App; and
- to make sure you are eligible and able to use the App in order to authenticate you when you use the App with your CASIO ID.

(2) Quality Purposes, i.e.:
- to monitor, and maintain the performance of the App and Product in order to review and improve our product and services, including the App and Product;
- to conduct user analyses for statistical, marketing, or other purposes for us to develop, review and improve the quality of and to promote sales of our products and services (including the App and Product);

(3) Contact Purpose, i.e.:
- to get in contact with you concerning your queries, or for any security and fraud prevention purposes;

(4) Marketing Purpose, i.e.:
- with your permission, as permitted by applicable law, to send you information materials (by email or via push notifications) by us and/or CASIO group entities about our and/or our CASIO group entities’ products, services (including our and/or CASIO group entities’ products and services which you have not yet used) as well as events and benefits (including special events, promotions and campaigns held by us or CASIO group entities) which might be of interest to you; and
- to operate our User Data Platform (defined in paragraph 11 below) where your Personal Data is recorded combining with a CASIO ID in order to efficiently conduct the above mentioned marketing purposes and to improve your satisfaction with this App, our and/or CASIO group entities’ products and services. You can unsubscribe from these at any time in your device settings or in-app settings.

If you - as the holder of parental responsibility - have agreed on behalf of your minor child, information of your child will not be processed for Marketing Purposes.
(5) Profiling Purpose, i.e.:
- to provide you customized marketing, so that the products and services can be tailored to meet your needs and the recommendations and offers displayed via the App and other online activities can be customized accordingly by analysing the usage of the App and Devices; and
- to conduct profiling your behavior with our User Data Platform in order to efficiently conduct the above mentioned marketing purposes and to improve your satisfaction with this App, our products and services. You can unsubscribe from these at any time in your device settings or in-app settings.

If you - as the holder of parental responsibility - have agreed on behalf of your minor child, information of your child will not be processed for Profiling Purposes.
We may share aggregated usage information with third parties for statistical and analytical purpose to develop, review and improve the products and services related to the App, provided such information cannot be used to identify specific individual.
5. Legal basis
We will process your Personal Data based on the explicit consent given by you. Alternatively, we will use your Personal Data for the purpose of rendering the requested contractual service and the performance of the contract as set forth in (1) to (3) of paragraph 4, acting on the basis of any other legal grounds, such as to comply with a legal obligation or a court order, or legitimate interest as set forth in (4) and (5) of paragraph 4, when permitted by applicable laws.
The withdrawal or revocation of your consent shall not affect the lawfulness of processing performed based on the explicit consent given by you, before your withdrawal. Upon withdrawal, your Personal Data could still be processed if there is a legal basis related to complying with a contractual obligation.
6. Management of Personal Data
We have taken steps to protect your Personal Data in an appropriate manner, including to protect personally identifiable information included in your Personal Data.
We have appropriate legal, organizational and technical security measures in place to prevent your Personal Data from being accidentally lost, used or accessed in an unauthorized way, improperly altered or disclosed. We also limit access to your Personal Data to employees, agents, contractors and other third parties who have a business need to know. They will only process your Personal Data on our instructions, and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspect Personal Data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.
We also establish the necessary rules to protect Personal Data, conducting trainings to our employees and taking other appropriate organizational, physical and technical security measures. If you would like to know more about the security measures implemented to protect your Personal Data, you can contact us and/or our DPO at the Contact Information described in paragraph 1.
We collect, use and disclose (including cross-border transfer) your Personal Data to the extent permitted or required under applicable laws. In addition to this Privacy Notice, we follow our “Privacy Policy”, which you will find at "https://world.casio.com/privacy".
7. Storage location
Your Personal Data is transmitted to and stored in a server operated by our service providers, which server may be located outside of your country. For more details, please see below.

8. Disclosing Personal Data to third parties
Your Personal Data may be disclosed to CASIO group entities, service providers and subcontractors as necessary to accomplish the Purposes.
Additionally, we may disclose your Personal Data to any judicial or governmental authorities, courts, external advisors, and similar third parties, if so required by them, in accordance with any applicable laws, rules or regulations.
9. Cross-border transfers
Your Personal Data may be transferred to, and stored by, a third party outside the country where you live, or which you were in when you used this App. Such countries include the countries in which our affiliates, subsidiaries, service providers and subcontractors above are located.
10. Connection with third party’s apps
The App has a feature to connect the App with certain apps provided by a third party ("Third Party Apps") by linking your user account of the Third Party Apps in order to automatically send your Personal Data in whole or in part to such Third Party Apps. Such feature is enabled by setting your user account of the Third Party Apps on the App following the App’s guidance. In no event your Personal Data will be sent to any Third Party Apps without your permission and your setting to do so.
Your Personal Data sent to the Third Party Apps by such feature will be processed by a provider of such Third Party Apps pursuant to applicable terms of use, privacy policy and other terms and conditions set forth by such provider. (In such case, this Privacy Notice will not apply to you.)
Within this app, the above settings can be used to link to Google Fit, and apply the customer data collected within Google Fit within the various functions of this app. In such instances, Casio will use the customer data collected by Google Fit within this app in accordance with the “Google Fit Developer and User Data Policy” established by Google, including the section pertaining to “Limited Uses of User Data”. The data derived from Google Fit and its uses within this app are as defined below.
- Data used within this app: step count, calories consumed, heart rate, distance traveled, movement speed
- Uses of this data within this app: This data will be used for body weight, step count, and distance displays, as well as to calculate other activity values based on this data.
User data collected within this app can also be linked to various functions within Google Fit. In such instances, personal information will be handled within Google Fit in accordance with Google’s privacy policy.
11. Analytics
Adobe Analytics
We use Adobe Analytics ("Adobe Analytics"), an analytics service provided by Adobe Systems Software Ireland Limited, located in Ireland ("Adobe") for conducting user analyses. Adobe Analytics uses cookies, which are text files placed on your mobile device or other hardware device, or certain unique identifiers for your device to help us analyze how users use the App.
The privacy policy of Adobe for Adobe Analytics is as follows:
User Data Platform
The data collected when you use the App, i.e., CASIO ID Data, Profile Data, Uploaded Data and Activity Data (excluding heartrate, step count, VO2max and any other data that can estimate your health status) stated paragraph 2 in this Privacy Notice, are measured by Adobe Analytics, provided by Adobe and transferred to a user data platform, provided by Treasure Data Japan, Inc., located in Japan ("User Data Platform"). The data collected in the server of Adobe Analytics will be automatically transferred to the User Data Platform once a day. Then, the data will be replicated in the User Data Platform and the data unnecessary for Marketing purpose and Profiling Purpose will be deleted or redacted. The data originally transferred to the User Data Platform will be retained without any change (i.e., not redacted or deleted). In the User Data Platform, the Profile Data, Uploaded Data and Activity Data (excluding heartrate, step count, VO2max and any other data that can estimate your health status) in anonymized form are checked against data connected with CASIO ID which are already recorded on the database.
If a device identifier connected to the device data matches that of the data connected with the CASIO ID, the Uploaded Data will be recorded against each concerned user's CASIO ID. CASIO group entities may access the User Data Platform to use the data recorded with each user's CASIO ID to the extent necessary for marketing activities and analysis in the market countries of such CASIO group entities.
You can unsubscribe from these at any time in your device settings or in-app settings.
12. Opt-out / Refusal
Generally, the processing of your Personal Data is voluntary. However, if you do not provide your Personal Data, your user experience of the App may be different or the use may be impossible.
By selecting the appropriate setting on the App, you may refuse or opt-out of the processing of your Personal Data.
While you may disable the usage of analytics tools through your device settings, we currently does not respond to a "Do Not Track" signal in the HTTP header from the App due to the lack of industry standard on how to interpret that signal.
13. Retention period
Your Personal Data will be retained only for as long as necessary for accomplishment of the Purposes, or as allowed by law. However, we need to keep your Personal Data to comply with legal or regulatory obligations to which Casio are subject. Further, if a judicial action is initiated, your Personal Data may be stored until the end of such action, including any potential periods for appeal, and will then be deleted or archived as permitted by applicable law.
We will cease to retain and will delete and remove your Personal Data from our systems and records and/or take steps to properly anonymize it so that you can no longer be identified from it, once the Purpose of processing is fulfilled, or after we confirm your request for erasure, or after operation of the corresponding product or service ends.
14. Your rights
You have a number of legal rights in relation to your Personal Data. These rights may vary depending on where you are located and which data protection laws will apply to the relationship between you and us, but would typically include;
(i) the right to obtain information regarding the processing of your Personal Data and to access to your Personal Data;
(ii) the right to request that we rectify and/or update your Personal Data if it is inaccurate or incomplete;
(iii) the right to request that we erase your Personal Data;
(iv) the right to request that we restrict our processing of your Personal Data;
(v) the right to object to us about our processing of your Personal Data;
(vi) the right to receive a copy of any of your Personal Data where this is technically feasible;
(vii) the right to withdraw your consent to our processing of your Personal Data; and
(viii) the right to transmit your Personal Data received from us to another entity without hindrance from us.

15. Children’s Privacy
If you have not yet reached the age of legal majority but are at least 16 years of age or as defined by applicable laws and legal requirements ("Under Age"), certain parts of this Privacy Notice also apply to the parent, legal guardian of a child or the holder of parental responsibility over you ("Parent"). However, if you are between 13 and this age threshold to give a lawful consent, we will request your Parent consent to using this App. If you are below the age of 13, we do not offer the services regarding this App to you. If we learn we have mistakenly or unintentionally collected or received Personal Data from a child without appropriate consent, we will delete it.
If you are Under Age, certain legal restrictions may apply and we may need the authorization of your Parent in order to process your Personal Data with regard to provision of the App. Therefore, we collect the Personal Data with regard to your Parent.
16. Changes to this Privacy Notice
We reserve the right to make any changes to this Privacy Notice. You will be notified adequately of any such changes. Such changes are effective immediately unless a different effective date is stated, however, if specifically required to do so by applicable laws, we will seek your prior consent before adopting such changes in respect of your Personal Data.
ADDITIONAL NOTICE FOR CALIFORNIA RESIDENTS

California’s consumer privacy laws, California’s "Shine the Light" law, and the California Online Privacy Protection Act provide consumers who are California residents with specific rights regarding their personal data. If you are a California resident, this Additional Notice for California Residents ("Additional Notice") describes your rights and explains how to exercise those rights and applies to California residents.
This Additional Notice forms part of the Privacy Notice for CASIO WATCHES last updated as of March 8, 2023 ("Privacy Notice") and prevails over any conflicting provisions in the Privacy Notice as they may apply to California residents.
1. Information we collect
Paragraph 2 of the Privacy Notice lists the categories of Personal Data we may collect from California residents. You are entitled to know whether we have collected and shared certain categories of information for a business purpose. In the 12 months preceding the last updated date of the Privacy Notice, we have collected or received the following categories of Personal Data about you:

(F) Internet or other similar network activity [*7] : the date and time of usage, activity and access to the App and other user activity data in the App and Devices;
(G) Geolocation data [*8] : your location data, including GPS, GNSS location data, Wi-Fi status information recorded by the Device ;
(H) Sensory Data [*9] : your profile photo or other photos and videos;
(I) Professional or employment-related information [*10] : Not Applicable;
(J) Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99)) [*11] : Not Applicable; and
(K) Inferences drawn from other personal information [*12] : the number of calories you burned, distance you travelled, sleep insights, and personalized activity goals, profiling data reflecting your preferences, behavior, attitudes in connection with the App, our Products, services and advertisement.

Some personal information included in this category may overlap with other categories.

[*5] D. Commercial information : i.e., Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
[*6] E. Biometric information : i.e., Genetic, physiological, behavioral, and biological characteristics, such as DNA sequences, fingerprints, facial geometry, voiceprints, iris or retina scans, and sleep, health or exercise data
[*7] F. Internet or other similar network activity: i.e., Browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement
[*8] G. Geolocation data : i.e., Physical location or movements.
[*9] H. Sensory data: i.e., Audio, electronic, visual, thermal, olfactory, or similar information.
[*10] I. Professional or employment-related information: i.e., Current or past job history or performance evaluations.
[*12] J. Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99)) is i.e.: education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records.
[*13] K. Inferences drawn from other personal information: i.e., Profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
2. How We Use Your Personal Data
Paragraph 4 of the Privacy Notice lists the business or commercial Purposes for which we may collect and process your Personal Data.
3. Personal Data We Share
We never sell your Personal Data. We share your Personal Data with certain third parties as described in the Privacy Notice. During the 12 months preceding the last updated date of the Privacy Notice, we disclosed the following categories of Personal Data within the scope of the Purposes described in paragraph 4 of the Privacy Notice:

We do not sell the Personal Data of California residents including the residents under 16 years of age, as the term “sell” is defined under California law. We share your Personal Data with certain third parties as described in this Privacy Notice.
California Residents’ Privacy Rights
Subject to certain exceptions, California residents have certain rights with respect to their personal information, including the right to:
- Request access to copies of your personal information;
- Request access to information about what categories of personal information we have collected from you, the categories of sources of such information, the business or commercial purposes for which we have collected or sold your personal information, the categories of third parties with whom we have shared your personal information, the categories of personal information that we have sold about you, and the categories of personal information that we have disclosed about you for a business purpose;
- Request deletion of your personal information;
- Request to opt out of the sale of your personal information; and
- Not be discriminated against because you exercised any of your California privacy rights.

To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your Personal Data or complying with your deletion request.
Upon receiving an access or deletion request from you, we will first verify your identity by requiring you to submit your name and e-mail address, and by matching the information you provide with what we already have on file.
If you use an authorized agent to make an access or deletion request on your behalf, we may require the authorized agent to provide proof that you gave the agent signed permission to make the request. Also, we may require you to either (1) verify your own identity directly with us (as described above), or (2) directly confirm with us that you provided the authorized agent permission to submit the request.
Your App and Device settings also let you exercise your right to access your Personal Data and to understand how we collect, use and disclose it, and exercise your right to delete Personal Data.
